Insufficient Funds

If a person issues a cheque without sufficient funds in the associated account to cover it, the cheque will be returned NSF (non-sufficient funds). In Quebec, an NSF cheque does not cancel the underlying debt. The dealer may demand immediate payment of the amount owed, plus any NSF or administration fees that were disclosed in advance. If the amount remains unpaid, the dealer may send a formal notice (mise en demeure) and pursue civil recovery before the courts of Quebec.

Fee Disclosure

Quebec’s Consumer Protection Act requires merchants to disclose applicable fees before they are charged. Customers who pay by cheque are advised that a returned or NSF cheque does not cancel the amount due. The original sum remains payable, and disclosed NSF or administration fees may also apply. Please verify payment terms with a sales associate before completing a transaction.

Civil and Criminal Recourse

Most NSF cheques are handled as a civil matter. The dealer may claim the amount of the cheque, disclosed fees and, where the law allows, interest and costs. Claims of $15,000 or less, excluding interest, may be brought before the Small Claims Division of the Court of Quebec. Issuing a cheque knowing there are insufficient funds, with intent to defraud, may also constitute an offence under the Criminal Code of Canada.

Formal Notice (Mise en demeure)

If a cheque is returned NSF, the dealer will typically send a formal notice (mise en demeure) to the customer’s last known address, stating the amount owed and a deadline to pay. Under the Civil Code of Québec, this notice generally places the debtor in default. If payment is not received within the time specified, the dealer may take legal action without further notice. Correspondence with consumers in Quebec is provided in French and may also be provided in English.
